GENERAL MEMBERSHIP CONDITIONS FOR THE EACIM ASSOCIATION
AND GENERAL CONDITIONS OF USE OF THE EACIM WEBSITE

EACim is an association governed by the French law of July 1, 1901, whose registered office is located at 65, avenue du Prado, 13006 Marseille (France), registered in the national directory of associations (RNA) under number W133031573 (hereinafter referred to as “the EACim association”).

This page contains the general terms and conditions that apply to any connection to the Website (hereinafter referred to as the “General Terms and Conditions of Use”), to any membership of the association EACim and to the subscription to the services of the association EACim to which the User may have access via the Website (hereinafter referred to as the “General Terms and Conditions of Membership”).

ARTICLE 1. PURPOSE – ENFORCEABILITY OF THE GENERAL TERMS AND CONDITIONS OF MEMBERSHIP

1.1. Purpose of the General Terms and Conditions of Membership

The present General Terms and Conditions of Membership define the rights and obligations of the Parties in the context of membership of the EACim association and subscription to the services that the EACim association offers its members (in particular access to their member space on the website and all its content).

1.2. Enforceability of General Membership Conditions

Unless otherwise agreed in writing, the relationship between the parties is governed exclusively by these General Terms and Conditions of Membership (in addition to the General Terms and Conditions of Use of the website), which are accepted without reservation by the Member.

Membership of the EACim association and subscription to EACim’s member services implies full acceptance by the Member of these General Terms and Conditions of Membership, the articles of association, the internal regulations and the General Terms and Conditions of Use of the eacim-ceramic-implantology.com website.

The present General Conditions of Membership may be modified at any time by EACim, and such modifications shall be immediately applicable upon publication on the eacim-ceramic-implantology.com website.

By accepting the present General Terms and Conditions of Membership and General Terms and Conditions of Use of the Website, the Member declares that he/she has the capacity to contract, i.e. that he/she is of legal age and not incapacitated.

In the event of contradiction between these General Terms and Conditions of Sale (GTCS) and any other document issued by the subscriber, these GTCS shall prevail.

ARTICLE 2. TERMS AND CONDITIONS OF EACIM MEMBERSHIP

2.1. Conditions of EACim membership

Participants who wish to join the EACim association must fulfill the following conditions:

  • have been, are or intend to be a dental health care professional (medical doctors, practicing or retired dental surgeons), or other health care professionals.
  • accept the present General Terms and Conditions of Membership, the General Terms and Conditions of Use of the Website, the Articles of Association of the EACim association published on the Website, and the internal rules and regulations in force on the day of membership, available on request by e-mail to the following address: contact@eacim-ceramic-implantology.com
  • pay a membership fee to the association, subject to cases of exemption, under the conditions set out in article 3 below.

2.2. How to join EACim

Membership of the EACim association and, where applicable, subscription to its member services, is carried out in the following stages via the website: the applicant follows the membership procedure described on the website and pays the membership fee, if due, by credit card online. Admission is confirmed by e-mail.

  • membership through EACim association’s website: the applicant for membership follows the membership procedure described on the website and pays the membership fee, if due, by credit card online or by bank transfer. The admission decision results from the confirmation sent to the applicant of his membership by e-mail notification.
  • membership by postal mailing: the candidate for membership returns to the EACIM association the registration form provided by the association (sent to the applicant on request or downloaded from the website) accompanied if it is due, the settlement of the membership fee. The admission decision is notified to the interested party by e-mail.

2.3. Duration of EACim membership

Membership of the EACim association is valid for the duration of the association, unless the Member resigns, dies or is excluded, from the date of payment of the annual membership fee (subject to refusal of membership by the Board of Directors), by credit card or from the date of collection of the direct debit from the Member.

Memberships / subscriptions are then renewed by tacit agreement for annual periods.

ARTICLE 3.  MEMBERSHIP FEES AND PAYMENT

3.1 Annual fees and membership formulas

On initial enrolment, the Adherent Member is required to pay an annual fee corresponding to the single formula available:

Dentist or dental professional membership for €180 for 365 days from the date of online membership (date of first invoice).
Student or Dental Assistant membership for €120 for 365 days from the date of online membership (date of first invoice).

3.2. Rates and financial conditions

Subscription rates are indicated on the EACim Association website and may be re-evaluated each year. In the event of a price change, subscribers will have the option of cancelling their subscription at no extra cost if the new price does not suit them.

3.3 Membership/subscription payment methods

The EACim Association offers the following payment methods for renewable subscriptions:

Payment by credit card: Subscribers can pay their subscription by credit card (Carte Bleue, Visa, Mastercard, etc.) using the secure STRIPE platform. Payment information is encrypted via SSL to ensure confidentiality.

3.4. Security rules for subscription by credit card or direct debit

In the case of online payment by credit card, payment is made via the STRIPE secure platform, published by STRIPE INC (3180 18th Street, CA 94110 San Francisco), which incorporates an SSL (Secure Socket Layer) encryption process, enabling the Member’s bank details to be encrypted during transmission over the network.

The EACim Association does not store the entire credit card number on its servers. Credit card numbers are processed by STRIPE, and transactions with Association EACim are based on authorization numbers, transaction numbers and merchant identifiers. Your credit card details are never transmitted unencrypted over the network.

Any order placed on the https://eacim-ceramic-implantology.com/ website implies that the Adherent Member accepts the general terms and conditions of use of the STRIPE platform. The Member is invited to read them at the time of the order, or on the following link: https://stripe.com/fr-FR/legal (containing the operation of this platform and the payment operations which can be carried out there).

3.5. Provisions in the event of unsuccessful payment

In the event of unsuccessful payment by credit card, and except in the event of theft or blocking, our secure payment service provider STRIPE may be required to represent the payment until it has been settled.

However, in the event of repeated non-payment, whatever the method of payment chosen, and after unsuccessful reminders from the EACim Association, the EACim Association reserves the right to terminate the current subscription, and even to cancel any possibility of subsequent subscription for a period of one year from the date of notification of termination.

ARTICLE 4.  TERMS AND CONDITIONS OF EACim SITE USE

4.1 – Services Provided by EACim to Adherent Members

Membership of the EACim association allows the Members to access:

  • all website content,
  • a Members’ Document Library providing free access to documents reserved exclusively for Member Members. The Adherent Member accesses this member’s space by logging into his or her User Account after entering his or her login and password.

The EACim association may have access to this space, which the Member Member accepts.

The EACim association may modify the conditions of access to this service or terminate it at any time, at its own discretion.

ARTICLE 5.  TERMINATION OF EACim MEMBERSHIP

5.1 – Services provided by EACim to its members

In the case of tacitly renewed subscriptions, the Subscribing Member may at any time refuse to keep your bank details and may easily exercise your right of opposition in order to cancel your subscription, using one of these three methods:

1/ Cancel a subscription by registered post with acknowledgement of receipt to the following address: EACim, 65, avenue du Prado, 13006 Marseille (France)

2/ Cancel a subscription online: once logged in, the Member simply accesses the “My Account & Settings” page, select the “My Subscription” tab and click on the “Cancel” link. This procedure will suspend the current order and indicate that you wish to cancel your contract.

3/ Cancel a subscription by sending an e-mail to the following address: adhesion@eacim-ceramic-implantology.com,

In all three cases, the cancellation request must be made at least one (1) month before the anniversary date of the subscription (i.e. the date of the previous invoice + 365 days).

In the event that the subscriber does not wish to renew the subscription within this period, the new annual subscription will be due

5.2 – Cancellation processing time

In all cases, EACim will process the customer’s request within a maximum of 5 working days. Cancellation will take effect on the first due date after this period.

ARTICLE 6. RIGHT OF WITHDRAWAL FROM EACim SERVICES

In accordance with the provisions of Article L. 121-21 of the French Consumer Code, the Member has a right of withdrawal regarding subscription to the EACim Member Services which it may exercise within fourteen (14) clear days. from the time of joining the services, subject to the following two (2) conditions:

  • notify the exercise of this right by e-mail to the following address: contact@eacim-ceramic-implantology.com or by post to the following address: EACim, 65, avenue du Prado, 13006 Marseille (France), before expiry of the aforementioned 14-day period,
  • that, in accordance with article L.121-21-7 of the French Consumer Code, the Member services have not been fully executed before the end of the withdrawal period, and that execution of these services has begun after the express prior agreement of the Member and the latter’s waiver of his or her right of withdrawal. Thus, in the context of the provision of Adherent services, any Adherent Member who requests full performance of the services before the end of the legal 14-day withdrawal period expressly waives his or her right of withdrawal.

Subject to the above two conditions, the EACim association undertakes to refund the price of the Member’s membership, free of charge, as soon as possible and at the latest within fourteen (14) days of the date on which the Member validly exercised his/her right of withdrawal.
In accordance with article L.121-21-5 of the French Consumer Code, a Member who requests partial, but not full, use of the Member services before the end of the withdrawal period may still exercise his or her right of withdrawal. In such a case, the EACim association is entitled to claim payment of an amount corresponding to the service provided until communication of its decision to withdraw, provided that the EACim association has received the express request of the Adherent Member for the performance of the said service during the period of its right of withdrawal.
Membership of the EACim association is acquired as soon as it is validated (after payment of the annual membership fee if due) and is not subject to any right of withdrawal within the meaning of article L.121-21 of the French Consumer Code.

ARTICLE 7. LIABILITY – GUARANTEES

The EACim association is subject to the obligation to protect the personal data of its members and site users in full compliance with the new European regulation RGPD, the European Data Protection Regulation, which came into force on May 25, 2018. This regulation is based on the following 4 principles: consent, individual rights, transparency and responsibility.

The EACim association is subject to an obligation of means in the context of the services it provides to its Member Members.

The association EACim does not provide any guarantee with regard to the information transmitted or obtained by the Member within the framework of its services. EACim cannot be held liable in any way whatsoever for the content of the information contained on the Site.

The use of any information by the Member is made under its sole responsibility and at its own risk.

EACim cannot be held liable for any direct or indirect damage resulting from the use of the Legal Consultations.

In any event, should EACim be held liable, its liability will be limited to the price of the Legal Consultation subscribed to by the Member concerned.

ARTICLE 8.  APPLICABLE LAW

The General Conditions of Membership are subject to French law. In case of dispute and in the absence of mutual agreement, the dispute will be brought before the competent French courts in accordance with the rules of jurisdiction in force.
